13rd-14th Lesson from the Book of Tawheed by Shaykhul-Islaam Muhammad bin Abdil-Wahhaab
بســـم اللــه الرحــمــن الـرحـــيــم
From the commentary on the Book of Tawheed by Shaykhul-Islaam Muhammad bin Abdil-Wahhaab may Allaah have mercy on him,13th-14th, Lesson,
By Shaykh, the ‘Allāmah, the Trustworthy Advisor, Abu ‘Abdirrahmān Yahya bin ‘Ali Al-Hajūri – may Allāh preserve him – on the 2nd, Jumaadah Al-Aakhirah, 1443H
Chapter: Not to slaughter for Allaah in a place where it is slaughtered for other than Allaah
And the statement of Allaah:
(لَا تَقُمْ فِيهِ أَبَدًاۚ لَّمَسْجِدٌ أُسِّسَ عَلَى ٱلتَّقْوَىٰ مِنْ أَوَّلِ يَوْمٍ أَحَقُّ أَن تَقُومَ فِيهِۚ فِيهِ رِجَالٌ يُحِبُّونَ أَن يَتَطَهَّرُوا۟ۚ وَٱللَّهُ يُحِبُّ ٱلْمُطَّهِّرِينَ)
"Never stand you therein. Verily, the mosque whose foundation was laid from the first day on piety is more worthy that you stand therein (to pray). In it are men who love to clean and to purify themselves. And Allah loves those who make themselves clean and pure."
[At-Taubah: 10]
عن ثابت بن الضحاك رضي الله عنه قال: ” نذر رجل أن ينحر إبلا ببوانة، فسأل النبي صلى الله عليه وسلم فقال: هل كان فيها وثن من أوثان الجاهلية يُعبد؟ قالوا: لا. قال: فهل كان فيها عيد من أعيادهم؟ قالوا: لا. فقال رسول الله صلى الله عليه وسلم: أوف بنذرك، فإنه لا وفاء لنذر في معصية الله، ولا فيما لا يملك ابن آدم” رواه أبو داود. وإسناده على شرطهما
And on the authority of Thaabit bin Dhahhaak may Allaah be pleased with him he said: “A man made an oath to slaughter a camel in Bawaanah, so the Prophet ﷺ asked and said: “Was there an idol from the idols of Jaahiliyyah that used to be worshipped there?” They said: “No.” He said: “Was there an Eid from there Eids there?” They said: “No.” So the Messenger of Allaah ﷺ said: “Fulfil your oath, for indeed there is no fulfilling of an oath in disobedience to Allaah, nor concerning what the son of Adaam (a person) doesn’t own.”
[Reported by Abu Daawud. And its chain is upon the condition of the two Shaykhs (Bukhaari and Muslim)]
In it are Masaa’il (topics):
The First: Tafseer of His statement:
(لَا تَقُمْ فِيهِ أَبَدًاۚ)
“Never stand you therein.”
[At-Taubah: 10]
The Second: That disobedience could affect the Earth, and likewise obedience.
The Third: Returning the ambiguous affair to the clear cut affair, to remove the ambiguity.
The Fourth: The Mufti asking for detail if he is in need of that.
The Fifth: That there is no problem with specifying a place with an oath if it is free from these preventions.
The Sixth: The proventions from it is if there was an idol from the idols of Jaahiliyyah, even if it be after its removal.
The Seventh: The preventions from it is if there was an Eid from their Eids, even after its removal.
The Eighth: That it’s not allowed to fulfil the oath in such places, because it’s an oath of disobedience.
The Nineth: Being cautious of resembling the Mushrikeen in their Eids, even if he didn’t intend it.
The Tenth: There is no oath in (things of) disobedience.
The Eleventh: There is no oath for the son of Adaam in regards to that which he does not own.
