Miscellaneous Benefits from Muntaqaa Ibn Al-Jarood may Allaah have mercy on him

By Shaykh, the ‘Allaamah, the Sincere Advisor, Abu ‘Abdirrahman Yahya bin ‘Ali Al-Hajoori – may Allaah preserve him

With what does a woman become a “Firaash”

The scholars have three statements:

  • Merely by the marital contract and this is falsehood.
  • The marital contract while there could have been a possibility of meeting.
  • At certain consummation of the marriage and this is what Shaykh-Ul-Islam and Ibn ul-Qayyim, may Allaah mercy on them, saw to be most correct.

Shaykh may Allaah preserve him said:

“A woman is not called Firaash except after the consummation of marriage not merely by marital contract, this is the correct opinion.”

Divorcing a woman before marrying her

The scholars have four statements:

The first: The statement that it counts upon its totality and it is the statement of Abee Hanifah.

The second: That it doesn’t count upon its totality and it is the statement of the majority.

The third: That there is detail in stipulating a specific woman from someone other than her( if I marry such a woman then she is divorced) and this is the statement of Maalik.

The fourth: Not taking a stance on the issue.

And the correct opinion is the statement of the majority and that it doesn’t count before the marital contract.

Maimoonah the wife of the Prophet ﷺ, he married her in the Umrah Qadhaa in the seventh year and she is the last of his wives.

Khadijah, then Sawdah, then Aa’ishah upon the correct opinion and the remainder of his wives he married after the Hijrah to Madeenah

The choice given by the Prophet ﷺ to his wives was that if they desired the worldly life he will separate from them and if they want what is with Allaah and the hereafter they were to remain with him and indeed they chose the Prophet ﷺ may Allaah be pleased with them

The most length of pregnancy It is established from Maalik bin Anas that he said the wife of his neighbour Muhammad bin ‘Ijlaan was pregnant for four years and this has come from numerous imams.
