Shaykh, the ‘Allaamah, the Sincere Advisor, Abu ‘Abdirrahman Yahya bin ‘Ali Al-Hajoori – may Allaah preserve him –
910 – Ahmed bin Sa’eed Ad-Daarimee narrated to us, he said Hibaan ya’nee Ibn Hilaal narrated to us, he said Jareer bin Hazim narrated to us, he said Ayyub used to narrate to me, on the authority of Zaid bin Aslam, so I met Zaid and asked him, so he said ‘Ataa bin Yaasir narrated to me, on the authority of Abee Sa’eed Al-Khudri, may Allaah be pleased with him, he said: “There used to be a camel belonging to a man from the Ansar which used to graze in front of Uhud, so it became ill so he slaughtered it with a stake, I said to Zaid:”(made) from iron or wood?”, he said:”No rather from wood”, he said then the Prophet ﷺ came so he asked him about it, so he ordered him to eat it.
the hadith is authentic only Nasaa’ee reported it from amongst the books of the sunnah (Bukhari, Muslim, Tirmidhi, Nasaa’ee, Abu Dawood, Ibn Majah) and it is in Sahih al Musnad (Shaykh Muqbil)…
911 – Ibraaheem bin ‘Abdillah narrated to us, he said Yazeed bin Harun informed us, he said Yahya informed us, on the authority of Naafi’, on the authority of Ibn ‘Umar, may Allaah be pleased with them both, that a woman used to herd goats belonging to them for Ka’b bin Malik in Sali’, so she feared death for a sheep, so he took a stone and slaughtered it with it, and that was mentioned to the Messenger of Allaah ﷺ so he ordered them to eat it.
912 – ‘Abdullah bin Haashim narrated to us, he said Yahya ya’nee Ibn Sa’eed narrated to us, on the authority of Shu’bah, he said Hishaam bin Zaid narrated to us, he said I heard Anas, may Allaah be pleased with him, saying: “The Messenger of Allaah prohibited from withholding cattle to be used as target practice.”
the hadith is Agreed upon(Bukhari and Muslim)
Explanation of the hadiths
It is benefited from the first hadith
910 hadith of Abee Sa’eed Al-Khudri, may Allaah be pleased with him.
➡️ From the integrity of Jareer bin Hazim that Ayyub narrated to him then he went above him in the chain (i.e to the person that narrated to Ayyub) and met Zaid (also) and took from him (the hadith), and didn’t abandon Ayyub, rather he mentioned him.
This hadith affirms the hadith of Raafi’ bin Khadeej which states that slaughtering is done even with wood or stone.
And the thing which inflicted this camel was either sickness or something else….the conclusion is that it was slaughtered so that it doesn’t die, and it is not left to die before slaughtering, in preservation of the wealth, and preservation of the blessing.
And his statement “So he ordered him to eat it, meaning this command was for permittance.
From the benefits hadith Ibn ‘Umar /911
In it is that the woman from her good dealings was that she without being appointed slaughtered the sheep so that it didnt die on its own.
And in it is that the slaughtering of a woman is eaten without any differing, whether she is a freewoman or a young slave girl, being able to distinguish or older, in the state of purity or menstruation, and whether it be a slaughtering by necessity or by choice, like ‘Aqeeqah, the Hady (sacrificial animal at Hajj) or Al-Udhiyah (sacrificial animal on Eid Ul-Adhaa).
Whatever makes the blood flow whether it be stones, or wood, or glass.
His statement: in the hadith “There used to be a man from the Ansar in the first hadith herding a camel that came close to death.
Condition of the tool use for slaughtering are two
1 – That it’s sharp.
2 – That it’s not a tooth, due to it being a bone, or a nail.
Issue:
Al- Haafidh (Ibn Hajr) said the hadith contains accepting the news of the employee.
➡️ In it is accepting the news of the singular narrations, the default state is that a trustworthy employees statement concerning herding is accepted, and in trading.
➡️ And in it is the permissibility of a trustworthy employee taking charge in situations when there is a benefit, except if the owner makes a condition on him not to then if they were to do so liability costs are due on the employee.
Explanation of the third hadith 912/ hadith Hishaam (Agreed upon)
Sabr ul-Bahaa’im
as-Sabr: (withholding)
Sabr ul-Bahaa’im is the withholding of animals for target practice, this is prohibited…
May Allah curse the one that uses a soul for target practice.
This contains torture to the animal and oppression, and Islam is a religion of mercy, and we have been ordered with being good to animals, and it contains wasting the possibility to slaughter it, and losing out on its benefit (food etc), and it is not allowed to eat the ‘Masboorah’ (animal used as target practice)
Benefit
➡️ The rabid dog consumes itself and doesn’t drink water and also it transgresses against other animals which would come across its path, if an animal is afflicted by the rabid dog, consuming it becomes impermissible.
The difference between al-Masboorah and casting at animal that has fled?
The difference is in intent and capability.
Meaning the ‘Masboorah’ is taken for this specific purpose of target practice as for the fleeing animal, its done because of lack of capability in catching it.
It was upon the ‘Masboorah’ to be slaughtered in a correct manner seeing as it was possible.
As for the fleeing animal, it’s not possible to slaughter in the normal fashion, due to its fleeing and escaping.
(Intent and Capability)
The difference between
Mujathimah and Jaathimah
➡️ The Mujathimah (animal which is tied to be shot to death): It’s owner made it ‘Mujathimah’.
➡️ The Jaathimah (an animal put itself into a trap and was shot to death): it made itself Jaathimah.
Ibn ul-Munthir, may Allaah have mercy on him, said: “The Masboorah (animals which have been taken as target practice) Al-Mujathimah (killed by its owner) are not to be eaten, and the majority of the people of knowledge are upon its prohibition and similarly the one that fled (from the animals classed as ‘Masboorah’) and fell into a well while in that state.
➡️ Hitting a bull with a hammer then slaughtering it is from the types of Tajtheem (trapping the animal) except that it is eaten and this (person) has not done good to the animal and Allah has ordered with doing good in all things.
