Understanding the Validity of Divorce While Intoxicated
Question: A man gave his wife divorce while intoxicated once before, and he has just divorced her again in an intoxicated state. Will this divorce be valid?
Answer: Divorce given in a state of intoxication is not valid. Therefore, if someone divorced his wife while intoxicated to the extent that he could not distinguish between right and wrong, the divorce will not take effect because a person in such a state is considered like a madman, who lacks reason, and a madman is exempt from accountability. For a divorce to be valid, the person must be fully conscious and aware of their actions.
