Al-Qur’ah (casting lots) is done between people who have the same, equal rights.
Benefit: Al-Qur’ah is done between one who does not have clear proof, and like if all of them have clear justifiable proof, so the clear proofs are set aside and it is returned to Al-Qur’ah concerning Al-Yameen (taking an oath).
Benefit: Ibn Ul-Qayyim mentioned in the pathways of wisdom that Al-Qur’ah can be in many things, from them;
- 1) If two sides are equal in terms of guardianship in marriage.
- 2) Washing the deceased and praying over him.
- 3) In traveling with one of (multiple) wives.
- 4) Custodianship of children if they (the guardians) are of the same status.
- 5) If two proofs clash.
- 6) If there was a struggle to get in the row (for the prayer), and all of them came at the same time.
- 7) Adhaan.
- 8) In Imaamah (rulership) if they are equal in what the hadith points towards.
- 9) Sitting in permissible places.
- 10) If two invitations occurred to a Waleemah at the same time.
And from the benefits of Al-Qur’ah is distinguishing the right of that which is obscure, and there is no deception or trickery in it.
