📚Mentioning the name of Allaah on the slaughtering of a muslim whom it is not known whether he mentioned the name of Allah over it or not

the hadith

Imam Ibn al-Jaarood may Allah have mercy on him said, Muhammad bin Yahya narrated to us, he said Muhaadhir narrated to us, he said Hishaam narrated to us, on the authority of his father, on the authority of ‘Aaishah, may Allaah be pleased with her, that she said, “A group of people came to the Prophet ﷺ so they said, verily we are given meat which we do not know if the name of Allaah has been mentioned over it or not, so he said, “Mention the name of Allaah and eat.”

The Men of the chain

Muhaadhir: bin Al-Mawraq Hassan Al-Hadeeth but he has a Mutaaba’.

Hishaam bin Urwah.

His father Urwah bin Az-Zubair.

The chain of narration with the author is hasan

due to Muhaadhir but the hadith is authentic and has been reported by Bukhari in the book of trading from the way of Muhammad bin ‘Abdurrahman At-Tafaawee and in the book of slaughtering by way of Usaamah bin Hafs Al-Madani, both of them on the authority of Hishaam bin ‘Urwah.

Bukhari and Ibn Jaarood chose to connect it and those that saw its connection were a number of trustworthy.

Issue: 📚

Meat imported from the lands of the Muslim can be eaten, the name of Allaah is mentioned and then eaten.

Issue:📚

Meat imported from the lands of the disbelievers is the opposite, it is not to be eaten, even if they say it has been slaughtered according to the Islamic way because it has been established that they kill by electricity and the blood remains in it, and the conclusion is that their slaughterings are not to be eaten, and the Muslims have been granted with a replacement of that which is better than theirs, the lands of the Muslims have a big animal populous and what is obligatory is staying away from that imported meat from the lands of the disbelievers.

Benefit:📚

The dead carcass was not prohibited except that its blood is still in it, and the (people that don’t let the blood flow) benefit from keeping the blood in the meat due to it increasing its weight.

Benefit:📚

What has come from the Islamic butchers is to be eaten, because it is the markets of the Muslims so having good thoughts of the Muslims is allowed, and occurring amongst them.

Issue:📚

The ruling of mentioning the name of Allah is that it’s obligatory, and if it is left it’s not to be eaten, because the mentioning of Allah’s name is a condition.

Benefit:📚

The one who forgets or the ignorant one, there is no sin upon him if he forgets to mention the name of Allah or is ignorant of its ruling, but the slaughter is NOT to be eaten and it takes the ruling of a dead carcass (Maytah), the sin is dropped from him but the meat is not eaten.

Issue:📚

Whoever leaves the mentioning of the name of Allaah intentionally is sinful and the meat is not to be eaten.

At-Tasmiyyah (mentioning the name of Allah): Is to say:

“بسم الله”

 ‘Bismillah’.

Benefit:📚

The condition of the Hady (sacrificial animal at Hajj) and  Udhiyyah (sacrificial animal on Eid Ul-Adha) is mentioning the name of Allaah.

Conclusion

It is not allowed to eat from that which the name of Allaah has not been mentioned over, Allah, the Most High, said:

(وَلَا تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْه)

Which translates to what means:

“Eat not (O believers) of that (meat) on which Allah’s Name has not been pronounced (at the time of the slaughtering of the animal)”

And Allah knows best
