◾Benefits from Muntaqaa Ibn Al-Jarood, Chapter: what has come concerning the drinks, 5th Lesson◾️

By Shaykh, the ‘Allaamah, the Sincere Advisor, Abu ‘Abdirrahman Yahya bin ‘Ali Al-Hajoori – may Allaah preserve him –

Chapter: What has come concerning the drinks.

861 – Muhammad bin Yahya narrated to us, he said that Aboo ‘Aasim narrated to us, he said Mahdi bin Maymoon informed us, he said Aboo Uthman al-Ansaari narrated to us, on the authority of al-Qaasim bin Muhammad, on the authority of Aa’ishah, may Allaah be pleased with her, she said: The Messenger of Allaah ﷺ said:

“Whatever intoxicates in a large amount then a handful of it is impermissible.”

The chain of the hadeeth with the author is authentic

📚Men of the chain

Abu ‘Aasim: He is adh-Dhahaak bin Makhlad an-Nabeel Basri trustworthy.

Mahdi bin Maymoon: He is al-Azdi Abu Yahya Basri trustworthy.

Uthman al-Ansaari Qadhi (Judge) of Mirwu trustworthy.

Al-Qaasim bin Muhammad bin Abee Bakr: One of the seven Fuqahaa, Ayyub said: He used to be the best of the people of his time.

862 – Ibn Jaarood may Allaah have mercy on him said Sa’d bin ‘Abdillah bin Abdil-Hakm and ‘Alaa bin al-Mugheerah narrated to us and both said Sa’eed bin Maryam narrated to us, he said Muhammad bin Ja’far informed us, he said Adh-Dhahaak bin ‘Uthman informed me, on the authority of Bukair bin ‘Abdillah Al-Ashajj, on the authority of ‘Aamir bin Sa’d, on the authority of his father, may Allaah be pleased with him, on the authority of the Messenger of Allaah ﷺ said:

“I prohibit you from consuming even a little of what intoxicates when drunk in multitude.”

The chain of the hadeeth with the author is authentic

📚Men of the chain

Sa’d bin ‘Abdil-Hakm Ibn Yunus declared him trustworthy.

Sae’ed bin Abee Maryam Misree (Egyptian) trustworthy.

Muhammad bin Ja’far He is Ibn Abee Katheer Al-Ansaari and he is the brother of Ismaa’eel bin Ja’far and they are both trustworthy.

Adh-Dhahaak bin Uthman one of the Imams of tafseer and his hadeeth are Hassan.

Sa’d bin Abee Waqqaas The first one to throw an arrow in the cause of Allaah (from the Arabs) Allaah made benefit by him in the (battle) of Qaadisiyyah a great benefit.

863 – And he said

Muhammad bin Yahya narrated to us, he said Abu ‘Aasim narrated to us, on the authority of Sufyan, on the authority of Alqamah bin Marthad on the authority of Suleiman bin Buraidah, on the authority of his father, that the Messenger of Allaah ﷺ said:

“Verily I used to prohibit you from visiting the graves but now visit them, for verily Muhammad has been given permission to visit his mother, and verily it reminds of the hereafter, and I prohibited you from holding on to the meat of the sacrificial animal for more than three days, i intended by that the people of means are not enriched over the people who do not have means, so eat and store, and I prohibited you from ‘Dharoof’ and verily the ‘dharf’ does not make lawful anything or impermissible it, and all intoxicants are unlawful.”

The chain of hadith with the author is authentic and Muslim reported it.

Abu ‘Aasim he is adh-Dhahaak bin Makhlad An-Nabeel trustworthy, firm.

Sufyan He is Ibn Sa’eed Ath-Thawree, they said in his biography (he is) a haafidh, a faqih, a worshipper, an Imam, a hujjah, all of this was said about Sufyan, so may Allaah have mercy on him.

📚Explanation of the hadith

This hadith is an abrogator and it has combined in it a number of abrogations

1 – Visiting the graves after the prohibition of visiting and the reason for the prohibition was in the beginning of Islam because they were close to the period of pre-islamic ignorance fearing that they would fall into what they were accustomed to in the pre-islamic days of ignorance from displeasure and confinement. For verily visiting the graves reminds of death and the hereafter as has come in other wordings (of the hadith)

📚 Issue

Are women allowed to visit the graves?

There is a difference of opinion…

And the correct opinion is that the prohibition was general for men and women so the abrogation is also general so it is allowed for all, men and women.

So the origin is the generality of the wording and the generality of the legislation except what is exempted by way of evidence.

As for the hadith:

(May Allaah curse the profuse female visitors of the graveyards and those who take torches there)

this hadith contains a severe threat in order to distance oneself from what the people of pre-islamic ignorance were upon of taking candles, and what it entails of shirk, so this is prohibited, as for mere visiting the graves then indeed the Prophet ﷺ passed by a woman at a grave crying so he said to her:

“Fear Allaah and be patient!”….. until the end of the hadith.

And he didn’t rebuke her for visiting her (deceased) child but rather he ordered her and encouraged her with patience, and Aa’ishah, may Allaah be pleased with her, used to visit the grave of her brother without being rebuked, and she followed the Prophet ﷺ to Al-Baqee’ while he visited her one night and he did not prevent her from entering Al-Baqee’ and she is the one who asked the Prophet ﷺ what to say when visiting the graves and he taught her what to say.

“So eat and store”..

This is after the prohibition of exceeding three days; and what remained over (three days) was given in charity, so giving in charity became a voluntary act.

3 – “And the ‘Dharoof’: meaning the vessels Adh-Dharoof does not prohibit nor make permissible anything and all intoxicants are unlawful like in the hadith.

Ash-Shawkaani, may Allaah have mercy on him, said in “As-Sail Al-Jaraar”: “The prohibition of alcohol has been established in the Book and the Sunnah and Consensus.”
